BBH group successfully advises on award procedure for public private partnership in the wind energy sector in the administrative district of Cham

A new wind energy project in the administrative district of Cham, with a planned capacity of 140 megawatts and an investment volume of €250 million, will make a significant contribution to the energy transition in the region. The BBH group assisted the parties involved through the entire process of establishing the public private partnership (PPP).

The project, which includes the planning, construction and operation of wind energy installations with an investment value of €250 million over the next 15 years, aims to make a significant contribution to a sustainable and citizen-friendly energy supply in the coming years. With a planned capacity of 140 megawatts of wind energy, the PPP project will not only drive forward the energy transition in the region, but also provide new impetus for municipal energy generation. It is planned to establish 7 wind farm companies as part of the project implementation by 2030. 

BBH provided comprehensive assistance to the intermunicipal company Regionalwerk Landkreis Cham gKU and all parties involved in all legal and contractual matters of the complex PPP process. BBH also provided advice on the establishment, objectives and business plan of the intermunicipal company itself. During the preparation and successful implementation of the EU-wide award procedure, particular attention was paid to compliance with EU procurement-related antitrust legislation, the objectives of the project for the municipality and the design of legally sound contractual arrangements under company, planning and construction contract law.
