The Berlin House of Representatives today approved the acceptance of Vattenfall GmbH’s offer to sell all of its shares in Stromnetz Berlin GmbH to a state-owned company. The members of the House of Representatives also approved the bid put forward by Stromnetz Berlin GmbH in the ongoing electricity concession procedure to conclude a new electricity concession contract. Thus, Berlin’s electricity grid is now back in public hands.
Today’s decisions put an end to the years of disputes over the remunicipalisation of Berlin’s electricity grid, Germany’s largest electricity distribution grid.
Under the lead of BBH partner and lawyer Astrid Meyer-Hetling, the law firm Becker Büttner Held (BBH) assisted the State of Berlin in the concession procedure both in and out of court as well as in the takeover of Stromnetz Berlin GmbH. BBH provided advice on all legal and energy-related matters regarding the concession award. In the transaction process for the takeover of Stromnetz Berlin GmbH, BBH provided comprehensive advice and assistance in the review of the takeover offer, which included, among others, an extensive due diligence investigation and a profitability analysis. The project team included lawyers, auditors, tax advisors and engineers with years of experience in the areas of concessions and transactions.
