Two renowned nuclear law experts of the law firm Becker Büttner Held (BBH), partner Dr. Olaf Däuper and Partner Of Counsel Dr. Dörte Fouquet, have been invited to the German Bundestag for the public hearing regarding the Seventeenth Act Amending the Atomic Energy Act to be held by the Committee on the Environment on 5 May.

The public hearing will address, among others, the question of how the measures for the security of nuclear installations, in particular regarding their protection against disruptive actions or other interference by third parties, can be further specified. In accordance with the so-called reservation of functions to the executive branch in relation to nuclear law, the responsibility for the identification and assessment of risks as well as  the specific design of the required protective measures against disruptive action by third parties lie with the competent specialist authorities and are subject to limited judicial review. The principle of the reservation of functions is now to be enshrined in the Seventeenth Act Amending the Atomic Energy Act (Siebzehntes Gesetz zur Änderung des Atomgesetzes – AtG) in order to allow for a final judicial evaluation despite the restricted submission of records.

On 5 May, BBH lawyers Dr. Olaf Däuper and Dr. Dörte Fouquet will discuss the specific design of the provision with the members of the Committee on the Environment.
